Constitution of the Moody Jr. High School
Student Government Association
Article I. Name
The name of the organization is the Student Government Association (SGA) of Moody Jr. High School.
Article II. Purpose
The Student Government Association (SGA) of Moody Jr. High School is an organization to better the educational and social environment for the student body and promote a forum for student expression. The SGA will serve as a facilitator between the student body and the administration as well as the student body and the faculty. The members of the SGA will develop attitudes of and practice good citizenship to promote the general welfare of the school.
Article III. Members
Section I
The SGA consists of the officers, the senate leader and the senate. The officers shall consist of a President, Vice-President, Secretary and Treasurer. The offices of President and Vice-President can only be filled by a member of the 8th grade class. The secretary and treasurer may be 7th or 8th graders. The number of students placed on the senate will be decided based on votes by the advisor and/or administration at the time of election. The student running for senate who receives the most votes will be named senate leader. The officers and council shall perform the duties described in this constitution and use parliamentary procedures adopted by this organization.
Section II
The advisor and/or administration may appoint the following officers: Social Chairperson, Historian, Publicity Chair and Community Service Chair.
Article IV. Qualifications of Officers and Senators
Section I
A student must have a 2.5 grade point average in academic classes and an “S” in citizenship from the previous year.
Section II
If a discipline file exists, the SGA advisor and administration will review the file. Upon review, eligibility for membership will be determined. Any student who currently has ten (10) demerits or more will not be eligible for SGA. Also, any student who has a referral to Day School, Alternative School or a Class IV Violation on their record will not be eligible for SGA.
Article V. Election Process
Section I
Anyone qualified to run for an office or senate position must complete the following requirements:
1. Complete the SGA application.
2. Campaign during the week of elections.
3. In order to run for President, Vice President, Secretary or Treasurer, a student must be nominated. However, any student may choose to run for Senate.
Potential members must complete the requirements and any other requirements deemed necessary by the SGA advisor. Failure to meet these requirements may result in dismissal from the election process.
Section II
Voting of candidates will be done by secret ballot.
Section III
If any office needing to be filled has no qualified person to run, the SGA advisor and administration shall fill this office by appointment. This policy will continue during the school term if a position becomes vacant.
Section IV
If any office is unopposed, the SGA advisor and administration will decide whether or not this person should be declared the winner based on his/her qualifications.
Section V
The election will be decided based on student vote.
Article VI. Duties of Officers and Senators
Section I
The president will preside over all SGA meetings. The president shall represent the SGA and school on all public occasions, and assume all other duties as are generally associated with this position. The president will only vote on matters in which the officers and council are equally divided. Committees will be named by the president as needed with the president serving as chairman of the executive committee. The president cannot be the president in any other major organization. The president must be knowledgeable of parliamentary procedures and the SGA constitution. The president will also be responsible for the creation of a bi-monthly agenda to be discussed during bi-monthly SGA meetings.
Section II
The vice-president will perform the duties of the president in his/her absence. The vice-president will be a standing member of all committees, be in charge of the yearly scrapbook, cast a vote in all motions (except when acting as the president) and will perform other duties as assigned by the SGA advisor. The vice-president must assist the president in the creation of bi-monthly agendas. The vice-president must also coordinate get well and sympathy cards for faculty, staff and students in extreme circumstances.
Section III
The secretary will keep a written record of all meetings and proceedings of the SGA and provide each member with a copy of the minutes, keep roll at all SGA meetings and functions, handle and record all official SGA correspondence, send out proper notice of all SGA meetings, cast a vote in all motions, and assume such other duties as are generally associated with this office. The secretary will keep the organization’s official membership roll and call roll when required. The secretary will be responsible for written correspondence.
Section IV
The treasurer shall maintain an accurate record of all SGA funds, assist the advisor, make a monthly report on the SGA’s financial condition to the SGA, be in charge of collecting items documenting all SGA activities for the scrapbook, cast a vote in all motions, and perform such other duties as are generally associated with this office.
Section V
The duties of the senators are:
1. To represent their class by attending all SGA meetings.
2. To serve on committees as needed.
3. To be the liaison between the SGA and the student body.
4. To attend all SGA activities and fundraisers.
Section VI
All officers and senators will take part in fundraising activities of the SGA and work to the best of their ability toward carrying out all activities and functions described by the SGA.
Section VII
All officers and senators will be required to pay dues of $20 per school year. Other required fees (not to exceed $20) may also be needed throughout the year for special events. These dues and fees are to be paid by the date designated by the SGA advisor. Failure to pay dues and/or fees will result in demerits according to Article VII, section four.
Article VII. Dismissal of Officers and Senators
Section I
An officer or senator of the SGA will be dismissed if they fail to uphold the duties and responsibilities of their office or fail to meet the requirements for the Moody Jr. High School and St. Clair County Code of Conduct. Suspension or expulsion from school will result in immediate removal from the SGA. Referral to the Day Program or Saturday School, or the act of a Class III or Class IV violation will result in immediate removal from the SGA. Accumulation of more than seven (7) school demerits in one semester will result in immediate removal from the SGA. Dues and/or fees will not be refunded.
Section II
A conference between an SGA officer or senator and the SGA advisor will occur in response to any disciplinary issue. Appropriate punishment will be administered in respect to SGA. If disciplinary issues continue, the SGA officer or senator may be removed from the SGA.
Section III
To insure proper conduct of all SGA members, a demerit system has been established. A total of seven (7) SGA demerits received in one school year will result in a four-week probation period from all SGA activities. A total of ten (10) SGA demerits received in any one school year will result in immediate dismissal from the SGA. The demerit system is as follows:
1. Tardiness to any SGA activity – one (1) demerit
2. Failure to attend work meetings – two (2) demerits
3. Failure to pay dues on time – two (2) demerits
4. Disrespect to a fellow SGA member – three (3) demerits
5. Disrespect to any school employee – four (4) demerits
6. Failure to assist in fundraisers or projects – five (5) demerits
The SGA advisor has the right to assign demerits whenever necessary. If an infraction is deemed serious enough, immediate removal of an SGA officer or senator can be made by the SGA advisor or administrator without using the demerit system. An SGA officer or senator may appeal a demerit by holding a conference with the SGA advisor. Demerits may be removed by the SGA advisor or an administrator only.
Article VIII. Committees
The president and SGA advisor will name committees as deemed necessary by the administration or SGA.
Article IX. Meetings
The SGA officers and the senate will meet bi-monthly following parliamentary procedures:

The SGA constitution shall be ratified by a two-thirds majority vote. Proposed amendments may be presented to the SGA and ratified by a two-thirds majority vote. The SGA advisor and administration will have final approval on any approved amendments.
